We have a deep understanding of the insurance industry and how it operates and will combine our knowledge of insurance market practices with our insurance law expertise, to deliver high quality advice efficiently.

Our contentious experience includes:

  • Acting for the underwriters in a high value and heavily contested coverage dispute under a marine war risks policy.  This high profile case, B Atlantic, was appealed to the Court of Appeal and then to the Supreme Court and ended with a judgement (and costs award) fully in our clients’ favour.

  • Advising on a USD 1 bn loss of production claim following a failure of the main bearing of an FPSO.

  • Advising on a coverage dispute relating to damage to wind turbine structures during transit following the collapse of a crane on a vessel.

  • Advising on substantial warranty insurance claims in relation to defects discovered on a recently completed FPSO.

  • Advising on a number of constructive total loss claims under war risks policies arising from detentions of vessels for a variety of reasons, including smuggling, illegal bunkering, collisions with loss of life and illegal anchoring.

  • Advising on a coverage dispute relating to damage to a generator on a power barge.

Our approach is to listen to the client and develop a strategy that is tailored to the client’s requirements.

Sometimes this entails assisting entirely in the background to help the client identify the best legal arguments to achieve a favourable commercial settlement. On other occasions this entails conducting heavy weight arbitration or litigation until its final conclusion.

Our non-contentious experience includes:

  • Advising on binding authority agreements, lineslips and facility agreements

  • Advising on the development of innovative policy wordings including:

    - a new excess control of well policy with a limit of liability of USD 1bn 

    - a new liability insurance policy for an EPIC contractor for an offshore wind farm project

  • Advising clients on the terms of insurance policies including policies of the following types:

    Construction All Risks, Builder’s All Risks, Delay in Stat Up, General Commercial Liability, Energy Exploration and Development, Professional Indemnity, Directors and Officers Liability, Management Liability, Public Liability, Professional Indemnity, Hull & Machinery, War Risks, P&I,  Cargo, Trade Credit and Property Insurance policies.
